Resolving disputes

If an employee is not satisfied with an employer’s decision regarding the level of demand of a task or personal performance, the employee can dispute the decision in writing.

A dispute regarding an assessment of the level of demand will be dealt with at the demand of the person or at his/her request a union representative in negotiations with the person’s superior or another representative of the employer and on either party’s initiative in the assessment group.

A dispute regarding an assessment of personal performance will be dealt with following a request by the person in question or a union representative in negotiations with the person’s superior or after the superior has handled the matter with a higher superior or another representative of the employer.

If the matter still has not been resolved, it can be forwarded for resolution according to the negotiation procedure in the collective agreement:

1. Unit-level negotiations between the superior or the employer’s representative and the employee or union representative.

2. Local negotiations between the employer’s representative and the union representative.

3. Negotiations at the union level.

If a matter cannot be resolved, it can be taken to the Labour Court for a decision.
